Short-term stream
Short-Term Stream (2-4 years): This fast-track option allows companies to address immediate and critical skill shortages. Ideal for filling specialised roles where no suitable Australian candidate exists. The visa allows you to work for a maximum of 2 years, potentially extending to 4 years under specific circumstances. However, you are restricted to working solely for the sponsoring employer who nominated you for the visa.
Medium-term stream
Medium-Term Stream (up to 4 years): This stream caters to situations requiring skilled workers for a longer period, typically up to 4 years. Similar to the short-term stream, you can generally only work for the sponsoring employer. However, it may offer a pathway to permanent residency if you meet specific requirements.
Labour Agreement stream
Labour Agreement Stream (variable): This stream caters to businesses with a pre-existing agreement with the Australian Government regarding specific skilled worker needs. The agreement dictates the work rights and limitations attached to the visa. You can only work for the employer and in the specific role outlined in the agreement, offering stability but with limited flexibility.
Subsequent entrant
Subsequent Entrant Stream (no set time): This stream is designed for family members of existing 482 visa holders. It allows your family to live in Australia and potentially work. However, this stream doesn't guarantee work rights. Family members would need to apply for separate work authorisation through another visa pathway.
Temporary Skill Shortage (TSS) Visa Subclass 482 Application Process
Step 1: Sponsorship Application
The first step in obtaining a Temporary Skill Shortage Visa TSS 482 visa is a sponsorship application submitted by the employer. The employer must be a lawful, actively operating business that complies with local labour laws and employment standards. This step ensures that only legitimate businesses in good standing can bring in overseas workers, supporting ethical employment practices.
Step 2: Nomination Application
Following the sponsorship approval, the second step involves a nomination application. This part of the process details the specific position to be filled, includes salary information, documents efforts made to recruit Australian workers, and assesses the ‘genuineness’ of the position to be filled. The nominating business must demonstrate viability and a genuine need to sponsor an employee from overseas.
Step 3: Visa Application
The final step is the visa application, which the nominated employee must complete. The applicant must provide evidence of the required skills for the nominated position and meet health and character requirements. This step confirms the employee’s qualifications, ensuring they are well-suited to contribute to Australia’s workforce.
