  • Be in Australia when you apply and at the time of grant
  • Hold or have held a substantive visa
  • Have made a valid application for a substantive visa that has not been finally determined, or have made an application for judicial review of a decision relating to your substantive visa application within the prescribed timeframe
  • Meet the character requirement
