Orphan Relative visa (subclass 837) Eligibility Requirements
To be eligible for the Orphan Relative visa (subclass 837), the child must meet the following requirements:
- Be under 18 years of age, single, and with no parent to care for them
- Have a relative who is a settled Australian citizen, eligible New Zealand citizen, or Australian permanent resident
- Be in Australia but not in immigration clearance when the application is made and when the Australian Department of Home Affairs make a decision
- Be sponsored by an eligible sibling or step-sibling, grandparent or step-grandparent, aunt, uncle, step-aunt, or step-uncle
- Have no parent who can care for them, either because they are deceased, permanently incapable of caring for the child, or can’t be found. The Department of Home Affairs will not grant this visa if the child’s parents are capable of caring for them but don’t want to
- Have consent to migrate to Australia, either with the written consent of everyone who can legally decide where they live, the laws of the child’s home country allowing them to leave their home country, or it is consistent with any Australian child order about the child
- Hold a substantive visa or have applied to get an Orphan Relative visa within 12 months of the previous substantive visa ceasing. The substantive visa they hold or last held cannot be a subclass 771 Transit visa
- Meet the health and character requirements
- Have paid back any debt owed to the Australian government
- Not have had a visa cancelled or a previous application refused
