Partner visa (Temporary) (subclass 820) Eligibility Requirements
To be eligible for this visa, you must meet the following requirements:
- Be in a genuine relationship with your spouse or de facto partner who is an Australian citizen, permanent resident, or eligible New Zealand citizen
- Have your Australian citizen, permanent resident, or eligible New Zealand citizen partner sponsor your application.
- Be in Australia when you apply for this visa and when the Australian Department of Home Affairs decide on your temporary visa application. The family members who applying with you must also be in Australia
- Not have had a visa cancelled or an application refused
- Not holding certain regional visas
- Be the right age
- Meet relationship requirements
- Meet our health requirement
- Meet our character requirement
- Have no debt to the Australian Government
- Best interests of the child.
- Meeting the English language requirements, if applicable.

- While the Partner visa (subclass 820) is temporary, it’s typically lodged together with the permanent Partner visa (subclass 801) in a single application. This streamlined process allows you to stay in Australia while your permanent residency is being assessed.

This means providing evidence that your relationship is legitimate and not entered into solely for immigration purposes.
